Climate change poses an unprecedented challenge to European legal systems, giving rise to an increasing wave of climate litigations. This thesis analyzes the case law of the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR), investigating whether their dialogue, often marked by procedural and substantive tensions, is fostering the emergence of a uniform European standard for climate protection. Examining access to justice and the substantive obligations of States within the two systems, this study conducts a comparative analysis of the normative frameworks and recent jurisprudence. The investigation concludes by examining the principle of intergenerational equity, analyzing its evolution from a global judicial trend to an interpretive standard for the Courts, and the need for formal recognition of the right to a healthy environment as a pillar of European legal harmonization.".
Il cambiamento climatico rappresenta una sfida senza precedenti per i sistemi giuridici europei, dando vita a una crescente ondata di contenziosi (climate litigations). La presente tesi analizza la giurisprudenza della Corte di Giustizia dell’Unione Europea (CGUE) e della Corte Europea dei Diritti dell’Uomo, indagando se il loro dialogo, spesso caratterizzato da tensioni procedurali e sostanziali, stia favorendo l’emergere di uno standard europeo unitario di protezione climatica. Il lavoro esamina, attraverso un’analisi comparativa dei quadri normativi e della giurisprudenza recente, l’accesso alla giustizia e gli obblighi sostanziali degli Stati garantiti all’interno dei due sistemi. L’indagine si conclude esaminando il principio di equità intergenerazionale, analizzando la sua evoluzione da tendenza giudiziaria globale a parametro interpretativo delle Corti, e la necessità di un riconoscimento formale del diritto a un ambiente salubre come pilastro dell’armonizzazione giuridica europea.
