Workplace discrimination on the grounds of disability remains an issue, despite legal protections aimed at promoting equality. This thesis seeks to explore the legal mechanisms through which the effects of discrimination can be mitigated and the strategies that can be adopted to prevent this phenomenon. The study analyses the legal framework governing anti-discrimination laws against people with disabilities, considering international, European, and national levels of regulation, especially those established by the United Nations and the European Union. It goes on covering the obligations towards disabled workers and their caregivers and the enforcement mechanisms that guarantee compliance within the workplaces, with reference to relevant case law. The thesis also contemplates how to best address and prevent workplace discrimination in a preventive manner, with a focus on promoting diversity, equity and inclusion policies and the role of the Disability Manager within organizations. Finally, it concludes with a case study focusing on the Italian Revenue Agency and its Guarantee Committee offering insights into practical applications of anti-discrimination and disability management policies.
