The recognition of the link between Human Rights and a safe environment can be considered one of the most relevant innovations in the field of International environmental law. A clean, healthy and sustainable environment is required to let human being enjoy their other fundamental rights, such as the right to life or the right to health. Even though it has not been recognized as legally binding yet, the endorsement of the right to a clean, healthy and sustainable environment is indeed the key for the protection of fundamental human rights in the contemporary panorama, since society is currently facing a massive challenge from a global point of view, concerning climate change. The EU is working on the implementation of a new, much more effective kind of legislation concerning environmental law, in particular, it is possible to make reference to the Environment Action Programme, to the European Green Deal and to the Nature Restoration Law. The aim of this thesis is to investigate whether the recent implementations in the field of European Environmental Law can develop a clean, healthy and sustainable environment within its territory. Is the European Union, through the “EAP to 2030”, the “European Green Deal” and the “Nature Restoration Law” fighting the issue of climate change with the aim of constructing an environment in which the right to a clean, healthy and sustainable environment is fully respected and granted to the society? Is the notion of climate justice endorsed and included in these agreements? In order to investigate the above mentioned thematic and in order to answer to these questions, this project will be developed building on four chapters. The main focus of the first chapter will be the inspection of the link between the environment and human rights and the analysis of the notion of the right to a clean, healthy and sustainable environment. While, in the second chapter it will be specifically explored the evolution of environmental legislation within the European context and it will be examined the implementation of the 8th Environment Action Programme, the “EAP to 2030” as further step in the fight against climate change. The third chapter, instead, will go into the detail of one of the most innovative measures ever implemented by the European Union concerning environmental policies, namely, the European Green Deal. In conclusion, the last chapter will analyse the consequences arising from the loss of biodiversity trough the specific measure adopted in order to stop the evolution of this process, which is the Nature Restoration Law.
Il riconoscimento dell’esistenza di una connessione tra i Diritti Umani ed un ambiente salubre è considerata senza dubbio una delle innovazioni più importanti per quanto riguarda il diritto ambientale internazionale. Un ambiente pulito, salubre ed in grado di garantire uno sviluppo sostenibile è considerato necessario per la creazione delle condizioni che permettono la protezione dei diversi Diritti Umani fondamentali, quali il diritto alla vita o il diritto alla salute. Nonostante non sia ancora stato riconosciuto come vincolante da un punto di vista giuridico, il riconoscimento del diritto ad un ambiente pulito, salubre e sostenibile può essere considerata la chiave per quanto riguarda la protezione dei diritti fondamentali, tenendo in considerazione l’importante sfida che la società internazionale sta affrontando al giorno d’oggi da un punto di vista globale, ossia il cambiamento climatico. L’Unione Europea sta lavorando sull’attuazione di una nuova e sempre più efficace tipologia di misure nel campo del diritto ambientale, nello specifico, si può fare riferimento al “programma d’azione per l’ambiente fino al 2030”, al “Green Deal europeo” e alla “regolamentazione sul ripristino della natura”. Lo scopo della seguente tesi è dunque quello di investigare se tramite la recente attuazione delle seguenti misure, l’Unione Europea sia in grado di sviluppare una regione dove il diritto ad un ambiente pulito, salubre e sostenibile è garantito. Dunque, è possibile affermare che l’Unione Europea tramite la messa in pratica di misure estremamente innovative nell’ambito del diritto ambientale, stia cercando di contrastare in modo sempre più efficace il fenomeno del cambiamento climatico costruendo un ambiente dove il diritto ad un ambiente salubre e sostenibile possa essere completamente rispettato e garantito a tutta la società europea? Il concetto di giustizia climatica, perciò, è riconosciuto e garantito nei sopracitati accordi?
